Terms of Service

Preamble

Supergene, Inc. (known henceforth as “the Company”) provides game services accessible through the following platforms: Meta Instant Games, Toss, CrazyGames, and TikTok (collectively, “Platforms”).

These are our Terms of Service (called “Terms”). Having made use of our Services means that you consent to the Terms of Service presented here. If you do not agree with any of the terms or are not able to do so, it would be advisable to discontinue your use of our Services.

By using our Services on any Platform, you also agree to that Platform’s own terms of service, which may take precedence over these Terms in platform-specific matters.

Article I — Purpose

The Terms of Service enumerate not only the rights and obligations of the users, but also any liabilities. Listed as well are the methods and conditions that are required for the use of the Company’s Services.

Article II — Notification and Revision of Terms of Service

The Company may make the necessary changes to the Terms should any need arise, provided that the changes are permissible under the law and other pertinent rulings. Once changes have been made to the Terms, the users shall be notified of these revisions by the Company the next time the user uses our Services.

For material changes, the Company will provide at least 7 days’ advance notice where technically feasible.

Should the users still make use of our Services, this is to entail that the users have understood the changes that have been made to the Terms and that they are agreed upon.

Article III — Applicable Provisions

What was not clearly defined in the Terms shall be classified under the Framework Act on Telecommunications, the Telecommunications Business Act, and other relevant rules and regulations.

In addition to these Terms, users accessing our Services through specific Platforms are also subject to:

  • Meta Instant Games: Meta Platform Terms and Facebook Instant Games Policies
  • Toss: Toss Terms of Service and relevant Toss platform policies
  • CrazyGames: CrazyGames Terms of Service and Community Guidelines
  • TikTok: TikTok Platform Terms, TikTok Mini Games Policies, and TikTok Community Guidelines

    • In the event of any conflict between these Terms and a Platform’s terms, the Platform’s terms shall prevail with respect to platform-specific matters.

    Article IV — Service Hours

    Barring any unforeseen technical difficulties and scheduled maintenance, our Services shall continue to run and will remain available for the duration of the year, within full (24 hour) days. The Company will have the right to postpone any and all of its services provided that the circumstances would prevent them from providing the users with the usual standard. Such circumstances may come in the form of, but not limited to, emergencies of the national level, errors that have to do with electrical failure, and a large amount of site-wide usage. The Company is likewise allowed to allocate and assign specific service hours for each particular service that they provide. The schedule of these services, and any changes that may occur, shall be made aware of by the users.

    Service availability may also be subject to limitations imposed by the applicable Platform.

    Article V — Obligations of the Users

    The users are forbidden to participate in or partake of any actions mentioned below:

  • Making use of the contents and services provided by the Company for anything except the user’s own private use, other than having the Company’s consent. Similarly, taking material from our Services and publishing them with any medium and handing them over to a third party;
  • Giving out information that would go against trademarks, patents, copyright, and other intellectual property to a third party via e-mail and other venues of communication;
  • Giving out information of the obscene variety in the form of words, images, and the like that may be harmful via e-mail and other venues of communication;
  • Taking part of an act that would constitute as illegal or a criminal;
  • Any action that would go against the law.
  • Attempting to circumvent platform-specific security measures, access controls, or terms of service of any Platform through which our Services are accessed.

    • The users of our Services shall consent to what is written by the Company in the Terms and follow the guidelines set by the Company.

    Users must also comply with the applicable rules and community guidelines of the Platform through which they access our Services.

    Using our Services for business and similar reasons, unless approved before by the Company, is not allowed. The Company is not liable should any ill befall the business venture. Any loss on the Company’s part should be shouldered by the user.

    The users are forbidden from using our Services to manage business activities including, but not limited to: hacking, publishing advertisements for the sole use of making money, peddling pornography and other disturbing phenomena. Any of these actions shall be dealt with by the relevant authorities and legal action could be taken against the user.

    Article VI — Transactions with Advertisers

    Any losses or damages that may have occurred due to another user’s taking part in promotional activities of an advertiser in which the services of the Company were used will not be made liable by the Company.

    Our Services may display advertisements from third-party advertising networks including Meta Audience Network and, for TikTok-based games, TikTok’s advertising services. Users may see personalized advertisements based on their Platform activity and preferences. Users may opt out of personalized advertising through the applicable Platform’s advertising settings.

    Article VI-A — Platform Data Sharing

    When a user accesses our Services through a Platform, the Platform may share certain user data with us as described in the Platform’s privacy policy. The Company processes such data in accordance with its Privacy Policy. The Company is not responsible for data collected or processed directly by the Platform.

    Article VII — Restriction of Use

    If a user were to participate in any of the actions listed below, the Company may choose to bar the user from using the Company’s services without prior notice for any period of time:

  • If a user has prevented the services of the Company from being delivered in a suitable manner;
  • If a user willingly and knowingly spread any harmful and offensive content that goes against morals and custom;
  • If a user, through the services provided by the Company, willingly makes use of those services against national interest and the well-being of society;
  • If a user has used our Services to intentionally harm another person, or is harmful in general;
  • If a user disrupts the stability and integrity of the services provided by the Company by inputting massive amounts of data or advertising;
  • If a user makes use of our Services to spread malicious software or viruses;
  • If a user infringes upon the intellectual property of the Company, other users, or third parties;
  • If a user reproduces or distributes information obtained through our Services for commercial purposes without prior consent from the Company;
  • If a user violates these Terms of Service or applicable laws;
  • If a user violates the terms, policies, or community guidelines of the Platform through which they access our Services.

    • Article VIII — Copyright

    “Content” refers to documents, graphics, images, audio, music, software, videos, and other creative works published or created by the Company. The Company and its licensors own the exclusive rights, interests, and titles, including all intellectual property rights, in and to the Services and Content. The Services and Content are protected by copyright, trademark, and other laws in the world. Users shall not remove, alter, or conceal any Content that indicates the Company’s ownership.

    Article IX — Damages

    The Company shall not be liable for any damages incurred by a user in connection with the use of free services, except in cases of intentional misconduct or gross negligence on the part of the Company.

    Article X — Disclaimer

  • The Company shall not be liable for failure to provide Services due to force majeure events such as natural disasters.
  • The Company shall not be liable for service disruptions attributable to the user.
  • The Company shall not be liable for any loss of expected profits or resulting damages.
  • The Company shall not be liable for the reliability or accuracy of information posted by users in the Services.
  • The Company shall not be liable for damages caused by the user’s intentional misconduct or negligence.
  • The Company shall not be liable for any criminal liability of a user whose content posted in the Services infringes on the copyright of others.
  • The Company shall not be liable for any damages arising from the operational policies, technical systems, service interruptions, or data loss of the Platforms (Meta, Toss, CrazyGames, TikTok) through which our Services are provided.

    • Article XI — Governing Law and Jurisdiction

    These Terms shall be interpreted and applied in accordance with the laws of the Republic of Korea. In the event of litigation between the Company and a user, where the user’s address is outside the Republic of Korea, the Seoul Central District Court shall have jurisdiction.

    However, for users residing in the EU, the right to bring proceedings before courts in the country of their residence, and their statutory rights under EU Member State consumer protection laws, shall not be excluded by these Terms. For users residing in the United States, applicable federal and state consumer protection laws may apply.
